The framework of our collaboration, in plain language.
Scope
These terms apply to all services provided under the Phainon brand by WYSS PERFORMANCE CONSULTING LLC-FZ or by professionals engaged by it, unless otherwise agreed in writing in the individual case.
Services
Phainon provides medical, diagnostic and advisory services within individually agreed programs. Content, scope and price follow from the respective program agreement. Medical services are provided exclusively upon indication and in permitted jurisdictions.
A specific treatment outcome is not owed. We owe careful, professional work according to the current state of knowledge.
Conclusion of contract
The first meeting serves mutual assessment and is non-binding. A contract is formed only upon signature of the program agreement by both parties or upon written confirmation. We reserve the right to decline enquiries without stating reasons.
Prices and payment
All prices are in Swiss francs (CHF), excluding any taxes, third-party laboratory costs and travel expenses unless stated otherwise. Programs are payable before they begin unless agreed otherwise. Third-party services (laboratories, partner clinics) may be invoiced directly by the provider.
Appointments and cancellation
Agreed appointments are binding. Cancellations are free of charge up to 48 hours before the appointment; after that we may invoice the effort incurred. For retreats and multi-day programs, the cancellation terms set out in the program agreement apply.
Cooperation
Effective accompaniment requires complete and truthful information about health, medication and history. Incomplete information can endanger safety and will, in case of doubt, lead to termination of the treatment.
Liability
We are liable for damages only in cases of intent and gross negligence, to the extent permitted by law. Liability for slight negligence and for lost profit is excluded to the extent permitted by law. Mandatory statutory liability provisions remain reserved.
Applicable law and jurisdiction
The law designated in the respective program agreement applies. In the absence of such designation, the law of the United Arab Emirates applies to services of the LLC-FZ. Mandatory consumer-protection and patient rights at the patient's place of residence remain unaffected.
